O alojamento local e a proteção dos direitos dos consumidores : contributo para o estudo do direito privado português

Abstract

A presente investigação tem como objeto central a análise do regime jurídico aplicável ao Alojamento Local no ordenamento jurídico português, com especial enfoque na proteção dos direitos dos consumidores. A crescente relevância social e económica deste fenómeno, conjugada com a expansão das plataformas digitais de reserva, levanta questões pertinentes de natureza contratual, legal e ética, que justificam uma análise aprofundada e crítica. Num primeiro momento, iremos proceder à clarificação do conceito de Alojamento Local, analisando a sua evolução histórica, o enquadramento legal vigente e a sua eventual qualificação enquanto contrato de consumo. É ainda objeto de estudo, a caracterização dos estabelecimentos de Alojamento Local, os requisitos legais exigidos para o seu exercício e as regras específicas de responsabilidade civil aplicáveis. Subsequentemente, a investigação irá debruça-se sobre os contratos celebrados à distância, designadamente através das plataformas digitais, bem como os direitos que assistem aos consumidores nestes contextos. Ao longo desta investigação serão objeto de uma reflexão crítica questões essenciais como, por exemplo, a transparência informativa, o direito de arrependimento, a responsabilidade por incumprimento e os desafios regulatórios suscitados pelo ambiente digital. Posteriormente, será examinada a problemática da utilização de frações autónomas, originalmente destinadas à habitação, para fins de Alojamento Local, explorando os conflitos que esta prática pode gerar no seio da propriedade horizontal, bem como os mecanismos de intervenção administrativa existentes. Por último, iremos dedicar-nos à análise do impacto que o regime do Alojamento Local exerce sobre o fenómeno da gentrificação de bairros históricos, ponderando-se os efeitos sociais, culturais e ambientais desta realidade, com vista à identificação de soluções jurídicas que permitam conciliar os interesses dos consumidores, a proteção das comunidades locais e a preservação da identidade urbana.

The main objective of this research is to analyse the legal framework governing Local Accommodation within the Portuguese legal system, with a particular focus on the protection of consumer rights. The increasing social and economic relevance of this phenomenon, combined with the proliferation of digital booking platforms, raises pertinent contractual, legal, and ethical issues that warrant comprehensive and critical examination. Initially, the study will seek to clarify the concept of Local Accommodation by analysing its historical evolution, current legal Framework, and potential classification as a consumer contract. Furthermore, this research will adress the characterisation of Local Accommodation establishments, the legal requirements applicable to their operation, and the specific rules of civil liability applicable. The research will focus on contracts concluded remotely, namely through digital platforms, as well as the rights that consumers have in these contexts. Throughout the study, essential issues will be the subject of critical reflection, such as information transparency, the right to regret, liability for non-compliance and the regulatory challenges raised by the digital environment. Subsequently, we will examine the issue of using autonomous units originally intended for residential purposes, for Local Accommodation purposes, exploring the conflicts that such use may generate within the Framework of horizontal property and mechanisms of administrative intervention available to adress them. Finally, we will focus on analyzing the impact of Local Accommodation on the gentrification of historic neighborhoods, considering the social, cultural and environmental implications, with a view to identifying legal solutions that reconcile consumers interests, the protection of local communities, and the preservation of urban identity.
