This study proposes a legal analysis of the possibility of awarding damages for emotional abandonment, understood as the unjustified omission in fulfilling the legal duties of care, cohabitation, and guidance, the absence of which compromises the full development of the child or adolescent. The research investigates how the legal systems of both Brazil and Portugal have addressed conflicts arising from the violation of the legal duty of care, with special attention to parent–child relationships and the breach of parental responsibilities. Subsequently, the dissertation presents the elements of subjective civil liability, with emphasis on unlawfulness and fault arising from the omission of the duty of care, understood as a legal value essential to the formation of the personality of the child or adolescent, highlighting the causal link between the omission and the psychological harm caused, as well as the criteria used in determining the amount of compensation. The analysis draws on landmark cases, such as the first judgment of the Brazilian Superior Court of Justice on the subject, contrasting the fear of trivializing the institute with the cautious and rigorous approach adopted by the courts in applying the legal requirements. In conclusion, it is asserted that liability for emotional abandonment should not be confused with the imposition of love, but rather with the legal recognition of the unjustified breach of the duty of care, the violation of which may give rise to civil reparation, provided that its constitutive elements are duly proven. |
