The present work on the topic of civil liability of companies in the context of sustainable and social responsibility, with special focus on environmental civil liability, had two main objectives: On the one hand, we sought to highlight the importance of environmental preservation, taking into consideration the matter of sustainability; on the other hand, we analyzed the role of civil liability in environmental protection, reflecting on the effectiveness of this legal instrument in preserving and repairing environmental damage, which are, in reality, collective environmental damages, given the very nature of the environmental. We therefore argue that this legal instrument (civil liability) plays an extremely relevant role in the environmental domain, considering its classic preventive and reparatory functions, but, on the other hand, it faces challenges and limitations that prevent its full effectiveness. Among the challenges and limitations identified, it is important to mention the risk of irreversibility, the diffuse nature of environmental goods, the indeterminacy of the persons affected by the damage, and the inequality of power and information between “potentially polluting” companies and the institutions responsible for monitoring, since, very often, the former hold more economic power and more information, which allows them to “escape” possible accountability. To try to minimize these and other limitations, the institute of civil liability renounces some of the traditional means used in civil law, resorting to mechanisms such as strict liability preventive liability, as well as the polluter-pays principle. On the one hand, we argue that civil liability in the environment context, on its own, is not sufficient to prevent and repair environmental damage, although it does play a relevant role in this regard. On the other hand, we argue that, for this legal instrument to be fully effective, it must be associated with other preventive means, such as administrative and regulatory instruments. ix In this sense, in our view, the prevention of environmental damage depends on a mere threat of liability and more on the practical application of these instruments. As for reparation, we understand that it is not always possible, since environmental damage is often irreversible, which makes this regime ineffective. Therefore, we also argue that the reparation regime is only viable when the damage is in fact repairable. In short, we believe that the full effectiveness of the environmental civil liability regimes is relative and insufficient to prevent and repair collective environmental damage, because it needs to rely on other mechanisms to ensure a more consistent and relevant effectiveness for the environment. To reach these conclusions, based on a qualitative approach, a bibliographical and legislative investigation specialized in the field of Civil Liability and Environmental Law was carried out. |
