In this dissertation our main theme will be about the executive process and the spouses’ joint or separate debts, and how it relates to marital assets and how this is interconnected with the assets of marriage and what is the relevance for assessing the responsability of the spouses. We will begin with a brief introduction to the civil process, focusing more on the executive process and the attachment phase, which is the most important phase. In the second part we will talk about the different kinds of marital property regimes, as well as everything that involves the spouses’ debts, with a greater focus on the Civil Code, that being said we will talk about the way the first ones relates to the spouses’ common debts or their own and wich assests can face the debt to be executed. We will also explore the differences between common debts and reportable debts and how this impacts the executive action. The third and final part of this dissertation will be inserted into the executive process where we will dedicate most of it to the incident of communicability of the debt, both raised by the creditor and the defendant, inserted in articles 741º and 742º of the CPC, respectively. At last, and still within this third part, we believe that the role of the non- debtor spouse deserves equal attention and what means of reaction are within their reach once cited to intervene in an executive action.
