The constant evolutions/changes of society, with the intrinsic complexity and risks, provoke a reassessment of the functions and structure of civil liability. The extension of the concept of damage has repercussions on the expansion of the protected duties. Given that, by virtue of the analysis of the current scenario of civil liability, the phenomenon of expansion of indemnifiable damages is verified, that is, the need for the existence of damage for there to be civil liability. Thus, the present dissertation aims to analyze indemnifiable damages and their classification: The concept of damage – event damage and loss damage, the classification of pecuniary and nonpecuniary damage and the types of damage existing in Portugal. Because the complexity of society has required new instruments of law to respond to social aspirations. I will demonstrate that under the economic classification of damage, which must be carried out on the basis of damage, there are only two types of possible damage: pecuniary and non-material damage. In addition to the fact that it is essential to standardize and elucidate relationships through comparative law in all types of damage that are not clearly and expressed in the Portuguese legal system, and also to provide a concrete response to real cases present in today's society, such as those interested /injured in relation to the different types of existing damages, namely the so-called “new damages”.
