The crime of domestic violence has terrorized countless lives, even before understanding the type of crime it is and how we understand it today. We started talking about domestic violence only from the twentieth century. Since then we have had an extraordinary evolution, both in terms of the protection of victims and the possibility of resocialization of aggressors. This crime consists of the adoption of violent behavior, which can affect both physically and psychologically the victim, and is currently enshrined in a plurioffensive legal asset that aims to protect more comprehensively all forms of existing domestic violence, with legal provision in article 152, CP. However, there are still problems in our society that make it difficult to report this crime, and it is also difficult to protect its victims immediately. In this way, we will analyze our legal system, analyzing the present mechanisms to understand if they meet their objectives and if they are effectively applied, as in the case of the measure of removal of the aggressor from the victim space, what is the benefit of applying the provisional suspension of the process and if we have implemented sufficient specific training so that those who deal with victims of domestic violence know how the chosen approach should be, abolishing discrimination and avoiding the feeling of humiliation by them. Finally, we realize that there has been an effort to treat this type of crime with more sensitivity, however, as stated by the report prepared by GREVIO, we have instruments that are not yet well applied and that we must focus more on and increase the number of training and awareness of the OPCs and the magistrates who deal with these crimes on a daily basis, also noting, from the GREVIO report, that we have less severe punishments, which can lead to low deterrence of this type of crime. |
