The digital economy is an increasingly striking topic in the economic world, where cryptoactives are considered by many to be the new (digital) gold as an alternative element of the traditional market, with a tendency to evolve and remain within our society at a global level. The growing globalization, internationalization, technological evolution and consequently the progressive contact between other states results in the need for constant adaptations by the various tax administrations in drafting the law, as regardless of all the contributions that the virtual world brought, it also allowed the opening of tax evasion by fraudulent taxpayers. As this work unfolds, we will realize that, regardless of the efforts implemented, through the 2023 State Budget law (hereinafter LOE2023), in the taxation of cryptoactives in Portugal, an incomplete regime is noticeable when complying with the principles applied to tax law and a notorious insufficient classification, leading to the emergence of numerous problems entailing risks, dangers and implications for the taxation of what the virtual asset is. It is pertinent to expose the legal regime within the scope of cryptoactives and, in this context, its lack of normative typification remains in constant legal-fiscal challenge of the current reality under discussion on several points.
