Direito ao conhecimento genético

Abstract

A dissertação aqui apresentada tem como escopo esclarecer a possibilidade do exercício de direito ao conhecimento da ascendência genética aos concebidos pela procriação medicamente assistida heteróloga e pelos adotados. A evolução científica verificada no domínio da biomedicina gerou diversas consequências no âmbito do Direito Constitucional, Direito Médico e no Direito Civil. As questões que antes não eram pautas de discussão, passaram a gerar conflito na doutrina e na jurisprudência, em razão de que o direito ao conhecimento das origens entra em conflito com o direito da manutenção do sigilo. Desde modo, será explanado os fundamentos do direito ao conhecimento das origens genéticas na Constituição da República Portuguesa, a técnica da procriação medicamente assistida, a busca pela ancestralidade do filho gerado pela procriação medicamente assistida heteróloga, o anonimato do doador e, por fim o direito à busca da ancestralidade pelo adotado. A metodologia usada para elaboração desta dissertação de mestrado será o princípio da analogia, a doutrina, a Lei da Procriação Medicamente Assistida e o Regime Jurídico do Processo de Adoção.

he following dissertation aims to clarify the possibility of exercising the right to acknowledge the genetic ancestry for those conceived by heterologous medically assisted procreation and by adoptees. The scientific evolution verified in the field of biomedicine has generated several consequences in the scope of Constitutional Law, Medical Law and Civil Law. The issues that were not discussed before lead to conflict between the doctrine and the jurisprudence, due to the fact that the right to know the origins conflicts with the right to maintain the anonymity. Thus, the fundamentals of the right to acknowledge the genetic origin in the Constitution of the Portuguese Republic, the techniques of medically assisted procreation, the search for the child´s ancestry generated by heterologous medically assisted procreation, the anonymity of the donor and finally about the right to search for ancestry by the adoptee. The methodology used to prepare this master´s dissertation is the principle of analogy, the doctrine, the Law of Medically Assisted Procreation and the Legal Regime of the Adoption Process.
