O direito de visita é só um direito dos progenitores

Abstract

Este trabalho consiste na reflexão sobre a seguinte questão: “O Direito de visita é só um Direito dos progenitores?” Estas constatações, que alicerça e fundamenta a consequente busca da resposta nesta tese, são uma problemática atual, cada vez mais evidenciada e vivenciada. Estamos perante uma evidência para a qual ainda não se encontram grandes respostas. A opinião diverge na jurisprudência e na doutrina. Este tema controverso muitas vezes é objeto de recurso para os Tribunais superiores e só se encontra uma norma no Código Civil que preceitua o seguinte “Os pais não podem injustificadamente privar os filhos do convívio com os irmãos e ascendentes”. O escopo desde trabalho incide em responder de forma objetiva e clara à pergunta acima referida. Sobre o direito de visita, questionamos se é apenas um direito dos progenitores, ou se podemos afirmar com toda a certeza e clareza que os avós também têm esse mesmo direito, deixando de parte o de visita dos irmãos, implícito na norma anteriormente exposta.

This work consists of reflecting and consequently responding to a major problem, which is the following “Is the right of visitation only a right of the parents?”. We are facing a great problem for which there are still no great answers. Opinion differs in jurisprudence and doctrine. This topic is often appealed to the higher courts and there is only one rule in the Civil Code that provides that "Parents cannot unjustifiably deprive their children of living with siblings and ascendants". The scope of this work is to answer objectively and clearly the question whether the right of visitation is only a right of the parents or whether we can state with certainty that the grandparents also have the same right to visit, leaving aside the right visit of the brothers implicit in the norm previously exposed.
