Título: O overbooking no transporte aéreo : em especial face ao Regulamento (CE) nº261/2004 do Parlamento Europeu e do Conselho, de 11 de fevereiro

Resumo: A dissertação debruçar-se-á sobre o overbooking, enfatizando alguns aspetos da aplicação prática do Regulamento (CE) n° 261/2004 do Parlamento Europeu e do Conselho, de 11 de fevereiro. Na demanda pela sistematização dos principais escritos sobre a matéria, transcrevo os principais autores nacionais, designadamente Carlos Neves Almeida, Gualdino Rodrigues e Matilde Pinto Vieira. Farei urna introdução ao contrato de transporte aéreo, distinguindo sinteticamente os diferentes tipos de transporte. Elencarei as fontes de direito aéreo, com especial relevo para as convenções de Paris, Varsóvia, Chicago e Montreal. Farei referência às diferenças entre os Regulamentos n° 295/29 1 de 4/2, revogado, e 261/2004 do Parlamento Europeu e do Conselho, de 11 de fevereiro. Descreverei as consequências da recusa de embarque e decorrente responsabilidade civil. Como a generalidade da Europa está sujeita ao Regulamento referido, compararei os regimes do outro continente mais significativo, concretamente no transporte aéreo brasileiro e norte-americano. Pela sua capital importância transcreverei a comunicação da Comissão ao Parlamento e Conselho Europeus, o 2011 White Paper on Transport, os resultados da consulta pública sobre a possível revisão do Regulamento (CE) no 261/2004 e a jurisprudência mais significativa do Tribunal Europeu sobre este Regulamento. Farei breve referência à quase inexistente jurisprudência nacional. Darei a minha interpretação pessoal sobre a responsabilização por overbooking. Procurarei concluir o tratamento do overbooking como tutela mínima do passageiro recusado, em que o princípio da boa fé e do equilíbrio das prestações enformam todo o contrato, obrigando a transportadora a um conjunto de deveres cujo incumprimento acarreta responsabilidade civil.
The present thesis aims to deal with overbooking, emphasizing some aspects of the current application of the comrnunitarian regulation (EC) no 261/2004 of the European Parliament and European Council, of February 11 th. In the search of systematization of the best texts about this issue, I’ll copy the major national authors, namely Carlos Neves Almeida, Gualdino Rodrigues and Matilde Pinto Vieira. I’ll make an introduction to the aerial transportation contract, concisely distinguishing, because it overflows the object of this thesis, the different types oftransportation. The sources of air law will be listed, with particular attention to the Paris, Warsaw, Chicago and Montreal conventions. I’ll refer to the differences between the regulations n° 295/291, of February 4th, repealed and n°261/2004 ofthe the European Parliament and of the Council, of February 1 lth. I’ll describe the consequences of denied boarding and arising liability. As the majority of europe is subject to the regulations above, I’ll compare the legal regimes of another more significant continent, particularly in the brazilian and north-american air transportation. For its capital importance, I’ll transcribe the Communication of the Committee to the Parliament and Council ofEurope, the 2011 White Paper on Transport, the results on the public consultation on the possible revision of Regulation (EC) n° 261/2004 and the most significant jurisprudence of the European Court on this regulation. I’II make brief reference to the aimost nonexistent national jurisprudence. I wil give my personal view on accountability for overbooking. I will seek to complete the treatment of overbooking as minimum protection of the refused passenger, the principie of good faith and of the balance ofbenefits underpinning ofthe entire contract, forcing the carrier to a set ofduties, the non accomplishment of wich implies liability.
