Título: Internamento compulsivo : sua contextualização

Resumo: O internamento compulsivo é definido como o internamento por decisão judicial do portador de anomalia psíquica grave, ou seja, em que se admite que o portador de anomalia psíquica possa ser internado sem o seu consentimento. Actualmente o internamento compulsivo encontra-se regulado pela Lei n.º 36/98, de 24 de Julho – Lei de Saúde Mental. O internamento compulsivo não é algo recente, bem pelo contrário, desde há muitos anos que o mesmo é praticado, no entanto, como não obedecia a qualquer regulação jurídica, os portadores de anomalia psíquica para além de se verem privados da sua liberdade ainda eram tratados de forma desumana e degradante. O presente trabalho propõe-se explicar o que é o internamento compulsivo, analisando o seu regime jurídico. Para o efeito, a investigação subjacente partiu da lei actual, interpretando-a e analisando-a criticamente à luz quer da legislação anterior, quer da forma como o mesmo tem sido analisado na doutrina e jurisprudência, assim como a forma em que tem sido tratado noutros países. Podemos depreender, com a realização deste trabalho, que o internamento compulsivo deve ser uma medida excepcional, uma vez que há uma grande restrição do direito à liberdade do portador de anomalia psíquica, a que a Constituição da República Portuguesa deu a devida autorização. Parece-nos, no entanto, que a Lei n.º 36/98, de 24 de Julho – Lei de Saúde Mental é pouco precisa nalgumas definições, o que deixa uma grande abrangência tanto aos médicos como ao juiz para aferirem dos pressupostos para a sua concretização, o que motivou parte da doutrina a questionar sobre a constitucionalidade daquela Lei.
Abstract: The compulsory hospitalization can be defined as hospitalization by court order of a severe mental disorder carrier, that is, whenever the mental disorder carrier can be admitted without his/her consent. Currently the compulsory detention is regulated by Law n.º 36/98, de 24 de Julho – (Portuguese) Mental Health Act. The compulsory detention is not a new subject, on the contrary, for many years it has been recognized and used by the courts as a legal expedient. However, only recently has this matter been codified into law, so that those suffering from mental disorders in addition to being deprived of their liberty used to be treated in an inhuman and degrading manner. This dissertation intends to explain what the compulsory detention consists of by analyzing its historical evolution from a legal point of view and its current legal status. For this purpose, the underlying investigation started by the current law, interpreting and analyzing it critically in the light of both the previous legislation and the way it was discussed in doctrine and jurisprudence, and ended in an analysis of the legal regime on this subject from other countries. Even though the Portuguese Constitution legally provides for the mental health law and its implications, this work intends to lead to the conclusion that the compulsory detention should be regarded as an exceptional measure, as it imposes a great restriction on the right to freedom of the mental disorder carrier, which is in itself a fundamental right legally protected by the constitution. It seems, however, that the Law n.º 36/98, de 24 de Julho – (Portuguese) Mental Health Act is imprecise in some aspects, therefore allowing a wide interpretative scope to both doctors and judges as to decide on the assumptions underlying its application. Thus, in the wake of this reality much of the doctrine has expressed doubts about the constitutionality of the law under consideration here.
