This study analyses the phenomenon of tax havens within the framework of International Tax Law, situating it at the boundary between lawful tax planning and unlawful tax evasion. It begins by identifying harmful tax competition as a structural manifestation of the coexistence of tax sovereignties in a context of global capital mobility, examining the coordinated response promoted by the OECD and the European Union. The article explores the European normative and jurisprudential framework, with particular emphasis on the international exchange of tax information and on the consolidation of the principle of prohibition of abuse of rights by the Court of Justice of the European Union, notably in the cases Leur-Bloem and Skatteministeriet. It critically assesses the impact of these measures on the legal sphere of taxpayers, in light of the principles of tax legality, proportionality, legal certainty and the fiscal sovereignty of States. Adopting a critical-dogmatic and comparative methodology, with reference to the Portuguese and Brazilian models, the study argues that combating base erosion requires an international tax cooperation framework structured according to a system of checks and balances, capable of reconciling revenue effectiveness, judicial oversight and the effective protection of taxpayers’ fundamental rights and guarantees.pt_PT
