In this article, we propose an analysis concerning intersubjective and algorithmic trust. By drawing on blockchain mechanisms, with particular emphasis on the so-called smart contracts, we seek to demonstrate how such technological models operate, while also highlighting the technological trust underpinning them. In turn, shall examine whether it is meaningful for the law to play any active role in relation to these database models, with particular attention being paid to the principle of good faith. Through the use of the deductive method, consideration will be given to the need to assign such mechanisms a primary role in commercial relationships, superseding traditional contracting. Accordingly, due consideration will be given the differences between conventional models and technological molds. Among other aspects, the following question will be raised: “Can technological trust, as a form of blockchain-based algorithmic regulation, replace good faith as a structuring principle of law?”. This analysis will address the concepts of blockchain, smart contracts, and good faith, and will also include an excursus on the adoption of blockchain technology through the hypothetical case study “Blockchain for donation management”.
