The research carried out in this article discusses and critically analyses the application of the principle of human dignity in the context of medically assisted procreation, based on the issues raised in ruling no. 101/2009 of 3 March by the Portuguese Constitutional Court. Based on the dissenting opinion in that ruling, the article argues that the principle of human dignity is not sufficiently developed in the ruling and emphasises the need to harmonise it with the constitutional regulation of medically assisted reproduction. In this specific case, the use of the principle of human dignity is reflected upon, both as an auxiliary interpretative tool in the weighing of fundamental rights and as a safeguard of the rule of law, and the definition of its subjective scope of application is scrutinised, with particular attention to the protection afforded to the human embryo. It thus demonstrates that the absence of a clear definition of the content of the principle of human dignity undermines the function of the Constitutional Court as guarantor of the supremacy of the Constitution, opening the way for excessive freedom on the part of the ordinary legislator.
