Abstract: O escopo do presente estudo é, ainda que de forma necessariamente breve, a tão atual temática do compliance (penal) ambiental.
The scope of the present study is, although necessarily brief, the very current topic of environmental (criminal) compliance. Knowing that Portuguese criminal legislation provides for not just one, but several types of environmental crime, we do so only with regard to the crime of pollution. This option, we believe, finds clear justification in the widely reported “polluting events” observed in Portugal (essentially related to water and air pollution). Following what has just been exposed, it is easy to see that “polluting events”, such as those mentioned above, are very directly linked to the business and industrial fabric (more exposed and sensitive to the “phenomenon”) of our country. This circumstance decisively leverages our option to “only” analyze that type of crime. Therefore, in order to pursue the proposed aim, it is necessarily necessary, in the first part of this study, to dissect (in general) the crime of pollution. Along this path, we will also analyze (it is mandatory that we do so) who the co mission of the aforementioned crime can be attributed to, always taking into account that, as a rule, only natural persons are susceptible to criminal liability. It turns out that, as we will see briefly but in more detail below, every rule has exceptions, which is why this topic deserves particular analysis. Subsequently, in a second part of this study, since we will deal with the topic of environmental criminal compliance (although with a focus, for the reasons already explained, on the crime of pollution), it is essential to outline an introductory and general framework about the concept of compliance itself: what it is, what it requires, how it is implemented and to what extent it interacts and intersects with the environmental crime mentioned. Having arrived here, in the third and final part of the present, it will be not only possible but imperative to draw and expose the conclusions that were possible to reach, which we will try to do.
