In the 21st century, for reasons that are not always clear and for which there is no unanimous explanation, characterised by some as modernity, the democratic state seems to have entered a process of erosion that has gradually given way to models which, while still claiming to be democratic, have compromised with forms of exercising power more readily available to components previously close to the non-democratic state. Are we facing a modernity capable of leaving a lasting mark on social evolution and its legal framework, as others have done in the past? Or is it just a convulsion that time will erase, as has already happened, suffice it to recall the largely failed act that humanism played in its time, when it at tempted to reformulate the knowledge and dissemination of Roman law in Europe? This text presents some elements which, from a historical and legal perspective, suggest that we may be facing a period of upheaval of uncertain duration, perhaps long, but which may not call into question the relevant part of the civilisational, philosophical, legal and political ballast that Western Europe has built up over the centuries, later adopted in other parts of the world.
