A formação profissional, certificação e regulamentação das profissões

Abstract

Este artigo procura estabelecer uma relação entre o mercado de trabalho e o mundo das profissões e procura indagar sobre as especificidades do funcionamento do mercado de trabalho e, nomeadamente, no que concerne à regulamentação das profissões. Os procedimentos da certificação profissional das formações e cursos educativos, a intervenção institucional e a defesa dos mercados contra a concorrência faz-se em nome do interesse público, da segurança e da saúde. A questão teórica da segmentação dos mercados é colocada e com efeitos na forma de ajustamento entre a oferta e a procura. Tal situação conduz a manifestações corporativas bem expressas no funcionamento das 18 Ordens Profissionais existentes em Portugal que abrangem cerca de 470.000 profissionais. Todas elas constituem monopólios de permissão do aceso e controlo do exercício das profissões mesmo depois das profissões serem legitimadas pelos organismos com função de os preparar no âmbito das leis em vigor.

This paper aims to relate the labor market to the field of careers and attempts to investigate how the labor market works, particularly with the regulation of careers. Procedures for the professional certification of training and educational courses, institutional intervention and the defense of markers against competition are done in the name of the public interest, safety and health. The theoretical question of the segmentation of markets is raised with effects on the form of adjustment between supply and demand. This situation leads to corporate manifestations well expressed in the operation of the 18 Professional Associations existing in Portugal, which cover about 470.000 professionals. All of them constitute monopolies of permission to access and control the exercise of professions even after the professions are legitimized by the bodies with the function of preparing them under the law's effect.
