O contrato de renda vitalícia : Regime jurídico, valências e outras perspetivas contratuais

Abstract

A presente investigação tem por objeto a análise do regime jurídico do contrato de renda vitalícia, abordando os diversos aspetos essenciais à celebração do negócio. Numa sociedade caracterizada pela progressiva perda de vínculos e insuficiência de resposta pública a problemas sociais como o envelhecimento, doença ou deficiência, torna-se necessário olhar, novamente, e de forma diferente, para figuras de contratação privada do passado, extraindo, no presente, o seu potencial. Propomo-nos estudar uma delas, o contrato de renda vitalícia. Sendo ainda pouco investigado pela nossa doutrina, o estudo deste contrato está alicerçado na história, nos regimes e na doutrina de outros ordenamentos jurídicos, em especial o francês, o italiano e o espanhol. Concluído o referido trabalho de análise apresentaremos demonstrações práticas e atuais das valências associadas ao contrato de renda vitalícia e uma pequena referenciação a outras perspetivas contratuais, também elas idóneas a um fim de previdência, umas conhecidas no nosso ordenamento jurídico outras ainda desconhecidas.

The purpose of this investigation is to analyse the legal framework of the life annuity contract, addressing the various aspects essential to the conclusion of the deal. In a society characterized by the progressive loss of ties and insufficient public response to social problems such as aging, illness or disability, it is necessary to look again, and in a different way, at private contracting figures from the past, extracting their potential in the present. We propose to study one of them, the life annuity contract. Since our doctrine still does not sufficiently investigate it, the study of this contract is based on the history, the regimes and the doctrine of other legal systems, in particular French, Italian and Spanish. At the end of this analysis, we will present practical and current demonstrations of the merits associated with the life annuity contract and a small reference to other contractual perspectives, which are also suitable for a social security purpose, some known in our legal system and others still unknown.
