Título: Responsabilidade civil em dano causado por mecanismo dotado de inteligência artificial

Resumo: Este trabalho tem como primordial objectivo explorar, de forma simples e com uma linguagem acessível os problemas que podem vir a surgir na atribuição de responsabilidade civil pelos danos causados por Mecanismos de Inteligência Artificial. Para isso, começamos por tentar definir o que é a Inteligência Artificial, como actua, onde actua e quais as áreas onde esta irá ser mais notada. Fazemos um paralelismo entre a definição de Robot e a de Inteligência Artificial e mostramos porque é que são dois conceitos distintos, que não se devem confundir nem ter um tratamento jurídico igual. À medida que vamos avançando neste trabalho, deixamos de parte as definições e conceitos, e avançamos para a contextualização do mesmo, de forma a conseguir explorar as intersecções entre o Direito e a Robótica. Tentando sempre discutir as diversas opiniões doutrinárias com base em vários artigos de opinião e fontes bibliográficas, sejam nacionais ou estrangeiras. Discutindo a questão da Responsabilidade Civil, da própria atribuição de personalidade jurídica a estes mecanismos. Abordamos ainda questões Éticas e laborais, como duas bandeiras estipuladoras de limites àquele que poderia ser o avanço desconcertado da Inteligência Artificial. Por fim, um escrutínio à Resolução do Parlamento Europeu, de 16 de Fevereiro de 2017, que contém recomendações à Comissão sobre disposições de Direito Civil sobre robótica, e ainda ao “Automated and Electric Vehicles Act”, que são, até à data, os dois exercícios legislativos mais relevantes sobre a temática dos mecanismos autónomos. Feita a reflexão sobre os recursos jurídicos existentes, conclui-se que, apesar de ainda ser cedo para a criação de um ramo autónomo do Direito ou da atribuição de personalidade jurídica a estes mecanismos, estamos longe de atingir a salvaguarda plena dos cidadãos e da sociedade no que diz respeito a este tema.
The main objective of this work is to explore, in a simple and accessible language, the problems that may arise in the attribution of tort liability for damages caused by Artificial Intelligence Mechanisms. So, we start by trying to define what Artificial Intelligence really is, how it acts, where it acts, and which areas their actions will have a bigger impact. We make a parallelism between the definition of Robot and the definition of Artificial Intelligence, in order to show why they are two distinct concepts, and that they should not be confused or have equal legal treatment. As we move forward in this work, we leave the definitions and concepts aside, and move towards the contextualization of it, in order to explore the intersections between Law and Robotics. Always trying to discuss the different opinions of the doctrine, based on several opinion articles, various bibliographic sources, whether national or foreign while discussing the issue of Civil Tort Liability, and the attribution, or not, of legal personality to these mechanisms. We also address Ethics and the impact on the labor tissue, such as two flags that should set limits and boundaries to what could be the disconcerted advance of Artificial Intelligence. Finally, we will make some comments on the European Parliament Resolution of 16 February 2017, which contains recommendations to the Commission on Civil Law provisions on robotics, as well as the “Automated and Electric Vehicles Act”, which are to date, the two most relevant legislative exercises on the subject of autonomous mechanisms. After the reflection on existing legal means, it is concluded that, although it is still early for the conception of an autonomous branch of law, we are far from achieving the full safeguard of citizens and society with regard to this topic.
