dc.description.abstractNo presente artigo procede-se à análise de um Acórdão do Tribunal Central Administrativo do Norte (TCA-N) de 20-11-2014 que decidiu o recurso interposto por um particular de sentença do Tribunal Administrativo e Fiscal do Porto (TAF-P) que julgou improcedente uma ação administrativa especial intentada contra o Município de Vila Nova de Gaia. Nesta ação pediu o Autor o reconhecimento da validade da sua pretensão de edificar no 4.º e último dos lotes resultantes de anterior operação de loteamento – e por consequência a anulação, ou declaração de nulidade, do ato expresso e de cariz revogatório, do competente órgão municipal, de indeferimento do pedido de informação prévia onde havia sido veiculada a dita pretensão construtiva. Todavia, não foi esse o entendimento do TCA-N, que confirmou a decisão do TAF-P, não sendo, no entanto, tal posição isenta de crítica.pt_PT
dc.description.abstractIn this article we analyze a ruling of the Central Administrative Court of the North (TCA-N) of November 20, 2014, which ruled the appeal filed by an individual of a ruling from the Administrative and Tax Tribunal of Porto (TAF-P) who dismissed a special administrative action against the Municipality of Vila Nova de Gaia. In this action, the Author requested the recognition of the validity of his claim to build in the fourth and last of the lots resulting from a previous subdivision operation - and consequently the annulment, or declaration of nullity, of the express and revocatory act of the competent municipal body, rejecting the request for prior information where the said constructive claim had been transmitted. However, this was not the understanding of TCA-N, which confirmed the TAF-P decision, but this position is not without criticism, as will be discussed below. Given the lesser interest of such segments in clarifying and understanding the legal issues that we have chosen to deal with, they are not transcribed from the text of the judgment under review, nor the reproduction of the parties’ claims, nor the part of the decision dealing with the issues raised in connection with a first tacit agreement on a prior complaint lodged with the body that would have practiced the contested act.pt_PT
