Os parlamentos nacionais e o processo decisório comunitário

Abstract

A mensagem limitada do Tratado de Nice justifica o propósito da Declaração de Laeken sobre o Futuro da Europa. Pelo seu lado, o carácter inconclusivo das últimas Conferências Intergovernamentais explica a aposta na Convenção para a reforma dos Tratados europeus. Entretanto, a vontade de mais democracia conduziu a um envolvimento activo dos Parlamentos nacionais no processo de decisão comunitário, para operar quer uma melhor fiscalização das posições tomadas pelos Governos em matéria europeia, quer um controlo político ex ante do princípio da subsidiariedade. Apesar das vicissitudes do Tratado Reformador, estes princípios acabaram acolhidos no Tratado de Lisboa.

The short message of the Nice Treaty justifies the aim of the Laeken Declaration on the Future of Europe. On the other hand, the inconclusive nature of the recent Intergovernmental Conferences explains the bet on the Convention for the reform of the European Treaties. Meanwhile, the desire for more democracy led to an active involvement of the national Parliaments in the EU decision-making process, to operate both a better monitoring of the positions taken by governments on European issues and an ex ante political control of the subsidiary principle. Despite the vicissitudes of the Reform Treaty, these principles were finally enshrined in the Lisbon Treaty.
