The idea of an area for the free movement of people has always been underlying the CPLP community. However, this area only materialized in July 2021, with the signing of the CPLP Mobility Agreement, allowing for greater freedom of movement between citizens of the respective signatory states, by reducing the formalities that had existed until then, while maintaining the need for a visa. However, the signing of this agreement has raised several questions, especially in Portugal, which is also a member of the Schengen area, having signed the corresponding agreement in June 1991. The Schengen Agreement allows the free movement of people within its area, without the need for any formalities. On the other hand, the integration of the Schengen acquis into the Treaty establishing the European Community through the Treaty of Amsterdam in 1997 allowed for the establishment of an area of freedom, security and justice, using the concept of an area, as was also the case with the Community’s own definition of the internal market. What's more, all CPLP member states are also parties to other agreements on this matter, since globalization and the synergies created in the aftermath of the Second World War have allowed them all to be interconnected with each other. The precarious economic situation of most of the states that were Portuguese colonies has led their nationals to seek better living conditions in other more developed countries. Portugal's strategic geographical location on the European continent makes it very attractive for these people to come to Portugal, as it allows access to all the European countries that are part of the Schengen area. It is in this context that Portugal's problems within the Schengen area begin, particularly in terms of the combination of both the Schengen and CPLP agreements. Portugal has even been issued with an infringement procedure by the European Commission, which considers that the CPLP mobility agreement does not comply with the Schengen acquis – in addition to violating the Schengen area. However, the problems are not restricted to Schengen: the citizens targeted by the CPLP Agreement also consider themselves to have been ‘cheated’ by Portugal, as they feel that their expectations have been disappointed in terms of the purpose and implementation of the Agreement. This dissertation analyzes the international agreements currently in force and the problems arising from their application, and attempts to determine whether it can be concluded that there is freedom of movement for Portuguese-speaking citizens. |
