| pt_PT |
| dc.description.abstract | The article examines the effectiveness of unilateral declarations in terminating contracts due to breach, arguing that Portuguese law adopts a model of extrajudicial termination, effective upon receipt of the creditor’s declaration. Drawing on the structure of obligations and Articles 432, 436 and 801 of the Civil Code, the author contends that termination is a formative potestative right, exercised ope voluntatis, without requiring prior judicial confirmation. The study contrasts opposing doctrinal views, analyses the role of good faith, and addresses issues such as anticipatory breach and the relationship between termination and damages. It concludes that Portuguese contract law relies on responsible private autonomy, with judicial review occurring only ex post. | en_EN |
