| pt_PT |
| dc.description.abstract | The 2007 reform of the Code of Criminal Procedure introduced a significant change in the treatment of non-autonomous facts, which was materialized through the amendment of Article 359. This legislative act, by explicitly regulating a matter that until then had been surrounded by various controversies and supported by disparate interpretations, raised new legal challenges that go beyond its mere normative application, directly affecting fundamental principles underlying criminal proceedings. This dissertation carries out a critical analysis of the historical, doctrinal, and jurisprudential evolution regarding non-autonomous facts, with particular emphasis on the 2007 reform, highlighting the persistent uncertainties and disputes surrounding this procedural concept. The research focuses on the complex relationship between legal certainty, the protection of the rights of the defendant, and the imperative of material justice, aiming to assess the practical impacts of the legal restrictions imposed on the consideration of such facts at trial. Beyond this evaluation of the balance between the fundamental values governing criminal procedure, particular attention is given to the position of the victim, whose interest may be compromised due to these existing limitations, raising a deeper reflection on the effectiveness of the criminal justice system in fulfilling its objectives. Finally, and as the central objective of this work, after identifying the gaps and shortcomings of the current regime, we propose a conceptual and practical reformulation, anchored in a rigorous compatibility between the principles guiding criminal procedural law and the rights of the defendant. This proposal aims to contribute to a more coherent, effective, and, above all, fairer criminal justice system, ensuring that procedural guarantees are respected without implying a renunciation of the realization of material justice. | pt_PT |
