This research focuses on the problem of obedience to superior orders in international criminal law, a problem that raises complex dilemmas and some dogmatic contradictions. Firstly, it aims to understand, by providing a historical and descriptive summary, how the grounds that have been invoked to justify the exclusion of criminal responsibility at the international level for criminal agents, whose driving force was an order issued by a superior, have evolved, in order to assess how the corresponding international criminal institution has been consolidated. Secondly, from a dogmatic-critical perspective, the aim is to analyse how doctrine – often substantiated by case law – has constructed and debated the concept of superior orders, both propaedeutically, at the domestic level, and particularly at the international level. Finally, it seeks to relate the legal-dogmatic subsidies presupposed by the figure of obedience to superior orders with the theoretical notion of control of the act, in order to assess whether, from a political-criminal point of view, it is considered appropriate to exclude international criminal responsibility from those who act under superior command.en_EN
