The family is a primary institution of the democratic state, protected by the principle of family protection, enshrined in Article 67 of the Constitution of the Portuguese Republic. As the basic cell for the organization of society, it regulates family organization, without being detached from the institutionalism that characterizes family law, insofar as the legislator limits itself to recognizing this right that arises from the organization and experience of the family itself within the constitutional principles in force. The legislator pays particular attention to children, their rights and the regulation of parental responsibilities. The constitutional legislator has enshrined the principle of equality between spouses and the principle that parents have the duty to raise and maintain their children (Article 36(3) and (5) of the CRP). In order to gain a full understanding of this last duty, we analyze the system for regulating the exercise of parental responsibilities in the Portuguese legal system.en_EN
