According to the Spanish High Court, the habitual residence constitutes the habitual residence of the family unit insofar as it must be the place where the family has lived together as such, with the intention of remaining there permanently. At European level, recital 53 of Regulation (EU) 2016/1103 cites as an example of a mandatory rule on the protection of the family home what this means in the practical application of the law, namely that, regardless of the legal system designated by the conflict rule, and provided that the law of the forum so provides, the consent of the non-owner spouse shall be required to dispose of, encumber or seriously compromise the use of the family home. This means that it must be established by the law of the forum. Thus, police laws are closely related to the protection of public interests, as well as preserving and safeguarding the weaker party in a relationship.
