At today’s crossroads of de constructions, revaluations, linguistic innovations and new narratives, it will be worth inquiring into some classical foundations. Certainly, some will be surprised by the dignity attributed to animals in Justinian’s Digest, when he makes them participants, along with human Persons, in Natural Law. Although Natural Law is currently only confined to very specific doctrinal subcultures, having generally been exiled from the curricula, Human Rights resist, although in a mix in which sometimes “the bad currency drives out the good”. This article seeks to consider some challenges that contemporary times (and especially in its most mediatized trends) have to face, doing so in dialogue with the background of the classical arsenal – which ranges from the Greco-Roman legacy to the French Revolution and its posterity, from the epistemic creation of Law to the consolidation of modern Constitutionalism. |
