Pode a migração ser um direito fundamental?

Abstract

O presente artigo pretende realizar uma reflexão sobre o direito de livre circulação de pessoas e as suas implicações no quadro de fluxos migratórios, à luz de textos normativos internacionais. Pretende-se enquadrar a questão no cenário de polarização política, examinando a tensão entre uma democracia maioritarista, expressa na ascensão da direita radical nativista, e uma democracia minoritarista, manifesta na cidadania global promovida pela esquerda progressista.

This article aims to reflect on the right to free circulation of people and its implications within the context of migratory flows in light of international normative texts. It seeks to frame the issue within the political polarization scenario, examining the tension between a majoritarian democracy, expressed in the rise of radical nativist right-wing movements, and a minoritarian democracy, manifested in global citizenship promoted by the progressive left.
