The theme of this dissertation focuses on the legal strategies for the protection of algorithms in the context of artificial intelligence, with particular emphasis on a comparative analysis of three central figures of intellectual property, patents, trade secrets, and copyright. In a world of increasing digitalization of societies and growing valorisation of technological assets arising from the use of algorithms in artificial intelligence systems, it is essential to analyse their legal nature and the most effective forms of protection. The study is structured into five chapters. The first chapter provides a general framework of artificial intelligence, addressing its historical evolution, philosophical foundations, the relevance of algorithms in the digital society, and the potential of autonomous creations by Al systems. The second chapter focuses on the legal framework of artificial intelligence within the domain of intellectual property, both at the international level and in the Portuguese and European Union legal contexts. The third chapter analyses the legal regime of patents, their respective requirements, and the possibility of protecting algorithms and Al systems through this means. The fourth chapter addresses trade secrets as an alternative means of protecting the know-how associated with algorithmic programming. Finally, the fifth chapter discusses copyright and its applicability to the protection of algorithms, including creations generated by autonomous systems, culminating in a comparative analysis of the three legal protection mechanisms examined. Through doctrinal, case-law, and legislative analysis, this dissertation seeks to identify the most appropriate instruments for safeguarding the interests of holders of artificial intelligence algorithms, taking into account their dynamic and technological nature, the risks associated with their misappropriation, and the limitations of the legal solutions currently available for the protection of such rights.
