Carta de 26 : o ex libris do constitucionalismo pré-social português

Abstract

O presente estudo suporta a ideia de que a Carta Constitucional de 1826 - não as Constituições monárquicas de 1822 ou de 1838, e menos, as Constituições republicanas de 1911 ou de 1918 - representa um equilíbrio entre tradição e renovação, entre soberania nacional e soberania popular, no qual a função moderadora se revela essencial, e explicativa da sua longa e profícua vigência.

This study supports the idea that the 1826 Constitutional Charter - not the monarchical Constitutions of 1822 or 1838, and certainly not the republican Constitutions of 1911 or 1918 - represents the balance between tradition and renewal, national sovereignty and popular sovereignty, in which the moderating function is asserted as essential, and explanatory of the long and fruitful validity.
