| pt_PT |
| dc.description.abstract | The Constitution of the Portuguese Republic of 1976 was a landmark in the consolidation of democracy after the coup d’état of 25th of April of 1974, in a context of ideological polarization during the Cold War. Our article aims to analyse how the Constitution of 1976 reflected the balance between influences from Western liberal democracies and communist regimes, attempting to position Portugal as a state in transition within Europe. Through a historical and theoretical approach, drawing on neoclassical realist theory of International Relations, the study examines the constitutional text, the negotiations in the Constituent Assembly, and Portugal’s role in the international system. We conclude that the Constitution of 1976 was a pragmatic compromise that avoided extreme polarization, aligning Portugal with the Western bloc and paving the way for European integration. Our study contributes to the understanding of democratic transitions in bipolar contexts and highlights the relevance of Portugal as a case study in Law and International Relations. | pt_PT |
