1933 : a constituição dual

Abstract

O presente ensaio visa identificar o ordenamento constitucional vigente em Portugal entre abril de 1933 e abril de 1974, perscrutando a dialética existente entre dois conjuntos normativos, um, a Constituição legislada, escrita, e o outro, a Constituição consuetudinária, não escrita, entre si contraditórios e conflituantes, não obstante as géneses de ambos se reverem num mesmo, e único, autor e personagem político, Salazar.

This essay aims to identify the constitutional order in force in Portugal between April 1933 and April 1974, examining the dialectic between two sets of norms, one, the legislated, written, Constitution, the other, the unwritten, customary, Constitution, contradictory and conflicting, despite the genesis of both being reflected in the same, and unique, author and political character, Salazar.
