| pt_PT |
| dc.description.abstract | Sport, which initially had nothing to do with economic activity, continued to have very little to do with other economic activities, even after becoming a major economic sector. The practice of sport, which initially had no connection to a profession, continued to bear little resemblance to other professions, even after becoming a genuine professional pursuit. The contractual relationship established between a club and a professional football player, which initially had nothing to do with employment relations, continued to bear little resemblance to other employment relations, even after evolving into an unquestionable employment relationship. The true meaning and scope of each of these three statements, which are now indisputable, cannot be fully understood through an analysis that focuses solely on the Portuguese context. A purely national approach would evidently fail to address the issues surrounding a globally prevalent activity that must be played under the same rules everywhere and organized in practically the same manner across different regions. Likewise, the understanding of these three statements would not be conceivable without considering the historical process that led to each of them, particularly the latter two – professional sport practice and the different configuration of sports employment relations in football – due to their greater relevance to the object of this investigation. The justification for the importance that this research attaches to the transformation of sport into a profession, and of this profession into a labor activity, is grounded in the idea that it is more difficult to comprehend the present without knowledge of the past, and even more challenging to devise the best solutions for the future. This is especially true when the objective is to understand the current situation and project the best future solutions for an activity with the popularity and media exposure of football – the so-called king of sports – and its various social, economic, and political ramifications. Taking as reference the most representative sport with the greatest economic impact – football – and guided primarily by the country where it originated, developed, consolidated, quickly expanded and evolved – England – this thesis aims to confirm those three assertions. Fundamentally, it seeks to confirm the transformation of medieval popular games into sports, the transformation of sport into an economic activity, the transformation of sports practice into a profession, and the transformation of professional sports practice into a fully-fledged employment activity. From this point onward, with a focus on football, the aim is to identify the shortcomings of the current Portuguese legal framework in addressing the specificities that best justify two of the aforementioned assertions. Firstly, the fact that professional sports practice has very little to do with other professions. Secondly, the fact that the employment relationship between the employing club and the professional football player bears little resemblance to other employment relationships, including other sports employment relationships. This specificity was evident at the very beginnings of professional football, at a time when sport did not arouse concern among established state authorities. It was a specificity that was essential for the sport’s global expansion, even before its formal recognition became widespread worldwide. Despite changes over the years, this specificity remains in place wherever football is played. Interestingly, this specificity became even more important after the European Union's involvement in sport, through a decision that appeared to threaten its very existence. Contrary to common belief, this specificity does not stem solely from the temporary nature of sports employment contracts, nor from the stabilizing effect of the mandatory fixed term. Rather, it arises from the combination of these two aspects and the omnipresence of external entities that regulate the sport both nationally and internationally. Specifically, sports federations, which have the exclusive responsibility to ensure that the relationship between the club and player is valid and effective not only in employment terms but also in sporting terms. This responsibility is expressed through the registration of the sports employment contract, which produces two key effects in the relationship. First, it associates the existing employment contract with a sporting bond. Second, it prevents the player from competing for another club during the term of the new sporting contract, which is also the basis for the exclusivity of the employment contract itself. It is precisely the combination of these four characteristics – two employment-related and two sport-related – that determines the dual significance, both sporting and economic, of the sports employment contract. These characteristics also give the relationship a distinct value that transcends its employment component and sets it apart from other forms of employment. Unlike other employment relationships, where the employer’s interest lies in the employee’s professional performance and the continuity of the relationship, in professional sports governed by a sports employment contract, only the sporting relevance of the relationship necessitates its continuation. However, its economic relevance – which has defined the relationship since the early days of professionalism – now requires the early termination of the relationship, and with it, the early loss of its sporting relevance. This early termination, however, is not just any form of termination but must be part of a broader, more complex process of the player's transfer to another club that seeks to capitalize on the player’s professional performance in organized competitions. This cannot happen without first extinguishing the effects of the previous registration made by the former club. Given the stabilizing nature of the mandatory fixed term in sports employment contracts, this termination cannot legally occur without the consent of the club, which benefits from the sporting effects produced by the federation’s registration. Yet, this termination also presupposes the early loss of the player's sporting performance for that club, a situation that will rarely happen without financial compensation. Ultimately, the key is to reveal the dominant role of economic rights underlying the sporting rights created by the registration of the sports employment contract, rights that are reinforced by the stabilizing term and the principle of the athlete’s exclusive use. These rights are realized when the early termination takes place as part of the athlete’s transfer to another club, in a process commonly known as a transfer. Once completed, the necessary effect is the termination of the previous registration and the corresponding sporting bond, enabling the new registration of a contract with the destination club. This ensures that the new club holds exclusive rights to the player's professional performance in organized competitions. This economic aspect is the true specificity of the sports employment relationship, and its protection should be a primary concern of any legal regime designed to address sports employment contracts in a special way. Without diminishing the importance of the various employment-specific aspects of the relationship, the legislator must prioritize the protection of this key differentiating feature of a relationship that, while employmentbased, is also inherently sporting. Given that this main distinction relies on the early termination of the sports employment contract, it would have been prudent for the legislator to provide better safeguards for this moment in the relationship. Or, at the very least, to allow the parties, either directly or through their representative bodies, to agree on the best way to address this critical aspect of contract termination. As will be seen in the final part of this investigation, this was not exactly the approach taken by the legislator in the current Law No. 54/2017, of July 14. Despite undeniable progress in certain key aspects of sports employment contract termination, the legislator leaned more towards the employment side of the relationship and failed to give equal attention to its economic side, even though this is its most distinctive feature. The legislator neither addressed nor allowed it to be addressed, despite the greater balance within the relationship. This was not done, not only because of the inexplicable revival of the principle of more favorable treatment for the employee, in its broadest form, which no longer has parallels in common employment relationships – thus restricting the bargaining power of the parties' representatives – but also due to the peculiar codification of fraud against the law, which restricts the bargaining power of the parties themselves. Additionally, this approach became even more problematic, and directly so, when the law established the automatic termination of the sporting bond produced by the registration of the sports employment contract at the very moment that the termination of the employment bond – whether lawful or not – is communicated to the federative authorities responsible for registration. Had it not been for the well-known probity of national club officials in the realm of player contracts, and the fact that Portuguese law only applies to national transfers, the Portuguese legislator could have dismantled the most traditional and important specificity of the sports employment relationship in football. This would mean that the Portuguese legislator might have acquired the unfortunate distinction of achieving something that even the European Union refrained from doing – namely, dismantling the economic dimension of a relationship that never operated solely based on its sporting aspect, and therefore never functioned solely on its employment dimension either. | pt_PT |
