| pt_PT |
| dc.description.abstract | The current Consumer Law has been strongly influenced and challenged by the new Digital Era. Traditional purchasing methods, based on physical contact between the retailer and the consumer, have given way to online commerce, as a remote contracting method, enabling a quick, easy purchase without having to travel. The consumer, increasingly dependent on the Internet and the products and services it makes available to him, has become an easy target, in a digital environment destined for irrational consumerism. The new weapons of the 21st century lie in refined marketing strategies, which sharpen the spirit of impulsive buying, to which are added new technologies, which provide a comfortable shopping experience, as well as algorithms, which help the merchant to increase his empire. In view of the above, the consumer's weakness, due to his position in the consumer legal relationship, is aggravated in an abstract context, where risks tend to increase. This scenario has aroused the attention of community institutions, which had been dormant for years, with a notable increase in legislative activity in the field of Consumer Law. In this way, taking as a vector the protection of the consumer in a digital environment, and with Community regulations being the guideline for Member States such as Portugal, the aim of this work is to analyze the Community legal framework regarding the protection of consumer rights, in order to assess whether it is adequate to the new issues raised by digitalization. In the same vein, we intend to take note of the Community legislative innovations in this context. Finally, not forgetting the Portuguese legal system, we will analyze the diplomas that transpose the Community regulations studied, with the same purpose of understanding whether the Portuguese legislator managed to go further than the Community legislator in terms of consumer protection in the digital environment. | pt_PT |
