Responsabilidade civil - Função punitiva
Data: 2024
1041ºCC and n.º 9 art. 1103 CC; o art.
Civil liability, as a source of the law of obligations, is based on the principle of repairing or compensating for damages and has several functions, primarily to repair the damage caused to others, but it has also a preventive and a punitive function. This one, resulting in a monetary compensation with a double purpose, repairing or compensating the damage caused and punishing the agent's behaviour. The main question is, whether the damage is the reason and the limit of the liability, as well as to assess the criteria for that quantum. Although the legal doctrine is not unanimous in this subject, we can affirm that are evidences in our legal system of the punitive function of the civil liability, such as civil liability with guilt; the use of equity (aequitas) to determine the amount of the compensation; the general irrelevance of the virtual cause; the non-material damages; the debtor's arrears; the compulsory financial penalty; the penalty clause; the signal; civil punishments (punitive amounts in the leasing, n.º 1 art. 1041ºCC and n.º 9 art. 1103 CC; the art. 1320ºCC regarding the wild animals; the art. 1552ºCC the right of free passage; and the bad faith possessor). Regardless of the Civil Code, there are other punitive functions manifestations that we must address, like the author rights, the labour law, the agency agreement and the insurance contract. The punitive damages belong to the tort, the commom law and they are surronded by controversy, but they are extremely effective. It is possible to recognize five functions of the punitive damages, three of wich are generally accepted and two that are dubious, meaning: the first one being the deterrence of similar egregious acts or behaviours by the defendant and others in the future; secondly, the punishment of the defendant for his wrongdoing; thirdly, the incentive for plaintiffs to bring claims on the society behalf; fourthly, compensation for non-pecuniary losses to the victim; and finally the compensation for attorney’s fees. Punitive damages and punitive function of the civil liabily are not synonyms but they are not antonyms either, they are different. Punitive function of the civil liability is a secondary function and the damage has a really central role in it and in the amount that is giving to repair or to compensate the plaintiff. The primarely function of the punitive damages is to deter and to punish the deffendant and for that to happen they are not tied to the damage and may not even be a mandatory requirement to be liable to pay punitive damages.
