The article proposes an analysis of the conceptual clash in the determination of nationality by International Law, which at times is understood as an effective bond and at other times as a fundamental right. To this end, a historical digression on the formation of States in the Western world is undertaken, with the aim of demonstrating how the evolution of this concept remains strongly tied to the political interests of the State. Based on classical and renowned authors, a brief historical reconstruction is presented, starting from Antiquity and reaching contemporary times. In the 20th century, especially after World War II, a series of international treaties elevated the concept of nationality to the status of a human right. In the final part, through an analysis of international case law, we demonstrate how international courts have addressed the issue. It is concluded that, in cases where the legal determination is linked to elements of investment or legal responsibility, preference has been given to the application of the effective bond criterion. On the other hand, when the objective is to ensure rights inherent to the very existence of the individual as such, nationality is recognized as a fundamental right.en_EN
