A teoria democrática em países com instituições incipientes

Abstract

Este artigo investiga a erosão constitucional como a sucessão de eventos que testemunhamos em diversos Estados ocidentais. A efetividade dos direitos fundamentais, a separação de poderes, a jurisdição constitucional, a regularidade das eleições e dos mandatos populares possibilitaram a perspectiva ocidental de que a democracia seria um regime político estabelecido, e que melhor preserva a liberdade, a propriedade e a igualdade. Os problemas globais que a democracia atualmente enfrenta reflete-se em países da América Latina, incluído o Brasil, possuindo, contudo, as singularidades de democracias recém instituídas, com características sociais, econômicas e políticas oriundas de formas autocráticas precedentes, o que torna mais complexa a tarefa de conter a erosão da Constituição.

This article investigates constitutional erosion as a succession of events that we have witnessed in several Western states. The effectiveness of fundamental rights, the separation of powers, judicial review, regular elections and popular mandates have made possible a Western perspective that democracy would be the a safe political regime that would best preserve freedom, property and equality. The problems that democracy faces globally are reflected in Latin American countries, including Brazil, which have, however, the singularities of newly established democracies, with social, economic and political characteristics originating from previous autocratic forms, which make the task of containing the erosion of the Constitution more complex.
