March 2023: the United Nations’ delegates took a historic decision in defining a new Model of Governance for the High Seas and attacking the problem of “international commons”. A new convention was created. The High Seas Treaty, as it was called, is an international legally binding instrument, under the United Nations Convention on the Law of the Sea, on the conservation and sustainable use of marine biological diversity of areas beyond national jurisdiction. This new convention stands for the integration of fundamental issues such as the exploitation of the seabed, marine genetic resources, fisheries, marine protected areas, scientific research and technology transfer. The purpose of this paper is to make a critical appraisal of this agreement, drawing attention to both, the route, and the substance, in a perspective that highlights the point of view of the fisheries sector. The analysis put in evidence the fundamental relationship between Development and Institutions.en_EN
