É neste contexto que, em 1895, é suprimido o pariato electivo, reduzido o número de membros da mesma câmara e limitado o total de nomeações permitidas ao monarca, aspectos rapidamente contestados pois com eles alterava-se o texto constitucional.; Divided into three periods, culminating in 1910, the Constitutional Charter of 29 April 1826 left an indelible mark on the Portuguese constitutional monarchy. However, some of its institutions were not without their share of discord, giving rise to disagreement amongst politicians and academics. One such example is the Chamber of Peers, a body modelled on other European political systems which introduced the bicameral system to Portugal. Fueled by successive royal appointments – the majority of which were justified by repeated requests from the Executive, giving rise to the infamous ‘batches’ – the Upper House lost its exclusively aristocratic nature with the establishment of the elective Peerage (1885). The measure was short-lived, however, as it was revoked a decade later by means of a highly controversial instrument: the dictatorial decree of 25 September 1895. With Parliament dissolved – a measure repeatedly adopted during the nineteenth century on the grounds of safeguarding state security – the Government became embroiled in a heated controversy, which could only be resolved through a no less controversial parliamentary ratification, then known as the ‘bill of indemnity’. It was against this backdrop that, in 1895, the elected peerage was abolished, the number of members of the House of Peers was reduced, and the total number of appointments the monarch was permitted to make was limited – measures that were swiftly contested as they altered the text of the Constitution.

Resumo: O objetivo primordial deste artigo é o de problematizar os possíveis significados da inclusão do poder moderador na Constituição do Império do Brasil de 1824 e na Carta constitucional de 1826 em Portugal, priorizando as circunstâncias históricas e o momento político que marcaram suas respectivas outorgas.&#xD;
The primary objective of this article is to problematize the possible meanings of the inclusion of the moderating power in the Constitution of the Empire of Brazil of 1824 and in the Constitutional Charter of 1826 in Portugal, prioritizing the historical circumstances and the political moment that marked their respective grantings. I consider that, based on the arguments and questions raised throughout the text, it is possible to hypothesize that, at the time of their implementation, both constitutional documents contained an instrument of government – the moderating power – that provided the monarch and his closest aides with an authority capable of weakening opponents and imposing a project of constitutional monarchy in Brazil and Portugal. My considerations privilege the complexity of the ongoing process, between 1822 and 1827, notably in the Court of Rio de Janeiro, in order to inquire into the ties that Dom Pedro maintained in Portugal while simultaneously seeking to consolidate, in Brazil, Independence and his public figure as Emperor.
