Resumo: Le présent article aborde les bouleversements politicoconstitutionnels auxquels on a assisté en Turquie à partir du 15 juillet 2016. Alors que l’état d’urgence a été proclamé afin de rétablir l’ordre public troublé par la tentative du coup d’état militaire, une modification constitutionnelle visant à la suppression du régime parlementaire a été effectuée dans les circonstances exceptionnelles. Dans cet article, on s’interroge d’abord sur la pratique de l’état d’urgence proclamé dans le cadre constitutionnel et encadré par la Constitution et la Convention européenne des droits de l’homme. Ensuite, la modification constitutionnelle (tellement radicale) dans la continuité de l’ordre constitutionnel est examinée aussi bien du point de vue du temps et de la procédure que des exigences de l’État de droit. On se demande enfin si le « nouvel ordre » ! est soutenable dans une organisation politique conçue comme un État de droit démocratique basé sur les droits de l’homme.; This paper discusses the politico-constitutional upheavals that took place in Turkey since 15 July 2016. While a state of emergency has been proclaimed to restore the public order disturbed by the attempted military coup, a constitutional modification, addressed to remove the parliamentary system, has been adopted under exceptional circumstances. The first question we considered in this paper is the constitutional practice of the state of emergency proclaimed, both in the perspective of the binding Constitution and the European Convention on Human Rights. Secondly, we analyzed the constitutional modifications, which appear very radical with respect to the continuity of the constitutional order, with respect to the time dimension of its effects, to the procedure adopted and the requirements of the rule of law. We finally asked ourselves whether such “new order”! is sustainable in a political organization conceived as a democratic State based on the rule of law and the respect of human rights.

Resumo: This article presents an overview of humanitarian intervention and the Responsibility to Protect doctrine, in terms of the main arguments surrounding the controversy concerning unilateral versus multilateral military action. Building on the literature that addresses this debate, the article identifies the main elements that support the idea that, while there are good reasons to legitimize unilateral interventions in specific circumstances, those interventions should be exceptional. The main argument is that multilateral interventions are the best alternative to, simultaneously, address the need to protect people threatened by mass atrocity crimes and the need to maintain international peace and security. Multilateral authorisations reduce the risk of conflicts emerging and spiralling among states, and in particular, the most powerful ones. They also reduce the likelihood of using the ‘humanitarian argument’ for intervening with different and self-serving agendas. In addition, they reduce the risk of abusive humanitarian intervention. Moreover, they foster more collaboration in terms of the need to address post-conflict situations and successful peacebuilding processes. Finally, they promote norm dissemination concerning the human rights agenda more effectively, particularly amongst non-liberal states.; O artigo apresenta uma análise sobre intervenção humanitária e a doutrina da Responsabilidade de Proteger em termos dos principais argumentos em redor da controvérsia das intervenções militares unilaterais versus multilaterais. Partindo da literatura que aborda este debate, o presente artigo identifica os principais elementos que dão suporte à ideia de que, apesar de existirem boas razões para legitimar intervenções unilaterais em casos muito específicos, esse tipo de intervenções deve manter-se excepcional. O argumento principal é o de que as intervenções multilaterais são a melhor opção para, simultaneamente, acautelar a necessidade de proteger populações ameaçadas por atrocidades e preservar a paz e a segurança internacionais. As autorizações multilaterais reduzem o risco de surgirem e escalarem conflitos entre Estados, em particular entre as maiores potências. Para além disso, reduzem a possibilidade de o ‘argumento humanitário’ ser utilizado para intervir com agendas diferentes e em benefício próprio. Depois, reduzem também os riscos de intervenção humanitária abusiva. Adicionalmente, fomentam mais colaboração para a necessidade de acautelar situações pós-conflito e processos de construção da paz com sucesso. E, para terminar, promovem a disseminação de normas relativas a direitos humanos de forma mais eficiente, muito particularmente, entre Estados não-liberais.

Resumo: O presente trabalho encontra-se subordinado ao tema «Política Externa Portuguesa: Bilateralismo e Multilateralismo».
O objectivo da nossa investigação pressupõe verificar a continuidade do bilateralismo enquanto eixo fundamental complementar do multilateralismo na Política Externa portuguesa. Para o efeito, procura-se esclarecer quais os princípios históricos orientadores da Política Externa portuguesa no Sistema Internacional, além de se pretender apurar o entendimento de Portugal face ao multilateralismo e a forma como a mudança de regime político alterou o seu posicionamento em relação a este. Procedemos a uma análise ao impacto da União Europeia sobre a acção externa de Portugal, assim como tratamos de observar a manutenção das tradicionais formas de bilateralismo.
O nosso trabalho permitiu-nos concluir que o bilateralismo na Política Externa portuguesa se mantém como uma realidade que opera em paralelo com a acção multilateral.; This work we now present is entitled: «Política Externa Portuguesa: Bilateralismo e Multilateralismo».
The objective of our research involves verifying the continuity of bilateralism as a fundamental axis in complement of multilateralism in Portuguese Foreign Policy. To this end, we seek to clarify the guiding historical principles of Portuguese Foreign Policy in the International System, moreover understanding Portugal’s position regarding multilateralism and how the change of political regime has altered its perceptions towards it. Hence, we examine the impact of the European Union on the external action of Portugal, as we try to observe the preservation of traditional forms of bilateralism.
Our work allowed us to conclude that bilateralism in Portuguese Foreign Policy remains a reality that works in parallel with the multilateral actions.
